Limited Use When Purchasing Products
The products on BecauseInternational.org have been designed to meet the immediate needs of children and adults living in poverty. As such, they are intended for humanitarian aid purposes only—not for personal use. By purchasing these product, you are agreeing to donate or distribute them to the intended audience. Further, you agree to respond to any requests for information regarding the donation or distribution of these product if/when prompted by Because International.
Unused Shoes
If products are not donated after you receive them, you can keep them for a future trip, identify another group of children/organization that could use the products, or send them back to us. If you send them back to Because International, we will identify an organization or group that is need of the products and will send to them. We try our best to track where the products are sent so we can follow up with the you after the shoes have been distributed.

All information provided in this Terms of Use agreement is owned by or licensed to Because International and protected by United States and international copyright laws. Because International retains all proprietary rights to the content in this agreement. Merchant Card Processing
The Stripe Checkout service (“Stripe Checkout”) is technology that makes it easier for merchants on the Internet (“Merchants”) to collect payment from individuals like you. Stripe Checkout also makes it easy for you to store a credit card or debit card (“Payment Credentials”) with Stripe for use across the websites of Merchants who’ve chosen to enable it. When you check out on our website, we will ask you if you’d like us to remember you. When you allow us to remember you, Stripe will store certain identifying information, such as a password, your email address, or your mobile phone number (“Stripe Credentials”), and your Payment Credentials. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the state of Washington, United State of America, and any action arising out of or relating to these terms shall be filed only in Pierce County, Washington, United State of America and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action.
Notice
Any notice given in connection with these Terms of Use shall be in writing and shall be delivered either by email, U.S. mail, certified mail, or fax. Notice shall be deemed delivered immediately upon personal service or facsimile transmission or forty-eight (48) hours after depositing notice or demand in the United States mail. Either party may change its address by giving written notice of the change to the other party.
Relationship of Parties
The relationship between the parties is that of independent contractors. Nothing contained in these Terms shall be construed as creating any agency, partnership, joint venture or other form of joint enterprise, employment or fiduciary relationship between the parties, and neither party shall have authority to contract for or bind the other party in any manner whatsoever.
Waiver
No waiver by BecauseInternational.org of any of the provisions of these Terms is effective unless explicitly set forth in writing and signed by BecauseInternational.org No failure to exercise, or delay in exercising, any rights, remedy, power or privilege arising from this Agreement operates or may be construed as a waiver thereof. No single or partial exercise of any right, remedy, power or privilege hereunder precludes any other or further exercise thereof or the exercise of any other right, remedy, power or privilege.
Severability
If any provision of these Terms is deemed unlawful, void, or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
Attorney’s Fees
In the event a lawsuit of any kind is instituted under these Terms or to obtain performance of any kind under this Agreement, the prevailing party shall be entitled to additional sums as the court may adjudge for reasonable attorneys’ fees, subject to the other party’s right to appeal.
Force Majeure
Neither party shall be liable for or deemed to be in default for any delay or failure to perform under this Agreement if such delay or failure to perform results from an act of God, civil or military authority, act of war, riot, insurrection, escalation of hostilities, or other occurrence beyond that party’s control. In such case, the intervening cause must not be caused by the party asserting it and the excused party is obligated to promptly perform in accordance with these Terms after the intervening cause ceases.
No Third Party Beneficiaries
These Terms are for the sole benefit of the parties hereto and their respective successors and permitted assigns and nothing herein, express or implied, is intended to or shall confer upon any other person or entity any legal or equitable right, benefit or remedy of any nature whatsoever under or by reason of these Terms.
Assignment
Customer shall not assign any of its rights or delegate any of its obligations under these Terms without the prior written consent of BecauseInternational.org Any purported assignment or delegation in violation of this Section is null and void. No assignment or delegation relieves Customer of any of its obligations under these Terms.
Entire Agreement
These Terms represents the entire Agreement between the parties with respect to the subject matter hereof, superseding all previous oral or written communications, representations or agreements. These Terms may be modified by BecauseInternational.org at any time without notice.
